We are the manufacturers and suppliers of very specialized magnetic and associated equipment. We are not able to enter into contracts based exclusively on some customers’ terms and conditions of purchase (which terms and conditions of purchase may be quite acceptable to other suppliers of conventional goods and services).
Whilst Magnattack® Global aims to secure the best possible results for its valued customers, 100% separation efficiency may not be achieved and cannot be guaranteed. This is because the effectiveness of magnets can vary due to factors beyond our control. These factors may include partial demagnetization over time, variations in flow, or variations of additives and moisture contents in materials processed. Other variables can be space restrictions, budget limitations and the degree of magnetic susceptibility of the magnetic contamination. These factors affect the degree in which a protective installation can be ideal and for how long the ongoing degree of separation efficiency is maintained.
In consideration of our accepting your business, you agree to accept our terms and conditions in this Legal Disclaimer and our Terms & Conditions of sale (and that those terms and conditions will prevail over the terms and conditions attached to your purchase orders to the extent of any inconsistency).
The purchaser understands that indemnities are limited to the extent of cover the seller’s present insurances provide, and on the basis that the buyer carries out its own risk assessment in relation to the product’s suitability and safety in the particular circumstances of use intended. Seller shall have no liability to the buyer to the extent such claims, demands, losses, and expenses are due to the negligence or misconduct of buyer, its employees, agents, officers, and directors. Buyer further agrees to indemnify, defend, and hold seller harmless, from any claims, demands, causes of action, liabilities or damages including attorney’s fees, arising from or relating to any claim arising from buyer’s modification or any other change being incorporated by buyer or at buyer’s direction, to the products.
